Terms of Service

1. Definitions

Seller – a registered user who uploads and offers Skills for sale, Buyer – a registered user who purchases Skills, Skill – any robot behavior, script, plugin, code package, configuration file, 3D model, or related digital robot asset, Listing – the sales page created by a Seller for a Skill.

2. Eligibility

You must be at least 16 years old and legally capable of entering into contracts.

3. Accounts

You are fully responsible for all activity on your account and for keeping your password secure.

4. Role of Cyisma

Cyisma is only a platform. We are not a party to the contract of sale between Seller and Buyer (except as payment facilitator via Stripe/PayPal) and we do not review, test, or guarantee any Skill.

5. Seller Rules & Warranties

By uploading a Skill you warrant that:

You own it or have full rights to sell/distribute it It does not infringe any third-party intellectual property or other rights It contains no viruses, malware, or malicious code

You grant each Buyer the exact license you select in the Listing.

6. Buyer Rules

Purchased Skills may only be used in accordance with the license granted by the Seller. Reselling or redistributing beyond the granted license is prohibited unless expressly permitted.

7. Payments & Fees

7.1 All payments are processed through Stripe and/or PayPal via ShareTribe. 7.2 Cyisma charges a 20% platform commission plus any payment-processor fees on every successful transaction. The remaining amount is paid out to the Seller. 7.3 All sales are final unless the Seller voluntarily refunds or Cyisma determines fraud.

8. Refunds & Disputes

Buyers may request a refund within 14 days of purchase if the Skill is materially not as described or completely non-functional. Disputes are handled through the platform; Cyisma may mediate.

9. Intellectual Property

Sellers retain ownership of their Skills but grant Cyisma a worldwide, royalty-free, perpetual license to host, display, and promote the Skills as required to operate the Marketplace.

10. Prohibited Activities

Users may not upload illegal, malicious, obscene, or infringing content; attempt to bypass payments; harass others; or scrape the site.

11. Termination

Cyisma may suspend or terminate any account at any time for violation of these Terms.

12. Disclaimer of Warranties

The Marketplace and all Skills are provided “AS IS” and “AS AVAILABLE” without any warranties of any kind.

13. Limitation of Liability

To the maximum extent permitted by law, Joe Ashworth / Cyisma shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Total liability is capped at the amount of commission fees Cyisma earned from the claiming user in the preceding 12 months.

14. Indemnification

You agree to indemnify and hold harmless Joe Ashworth / Cyisma from any claims, losses, or expenses (including legal fees) arising from your use of the Marketplace or your breach of these Terms.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute shall be resolved exclusively in the state or federal courts located in New Castle County, Delaware, USA.

16. Changes to Terms

We may modify these Terms at any time. Continued use of Cyisma after changes constitutes acceptance of the updated Terms.
